According to the new Ministerial Decision No. 25 dated February 17, 2001, the fees for publication in the Trademark Journal should be paid within thirty days from the date of the publication notice. Previously the payment of fees was made upon submitting the publication notice to the Official Gazette for publication. With the new regulations the publication fees should be paid immediately upon the acceptance of the trademark within the 30-day period.
The above resolution came into effect from the day it was issued, i.e. February 17, 2001. Currently all trademark agents are receiving the acceptances with these notices as well as upon receiving the conditional acceptance notices. The applicants should agree to the conditions that the publication fees are to paid within the 30-day deadline.
This new practice is there to facilitate issuance of the Trademark Journal instead of the publication in the official gazette as per the Federal Law No. 19/2000.
The first issue of the Trademark Journal released by the Trademark Department should be released by the end of March beginning April 2001. The AGIP Bulletin will be reporting on it in due course
