NEW RESOLUTION N° D-029/00 EXPEDITIOUS WAY TO GRANT PATENTS
In order to reduce the backlog of patent resolutions, the Argentine Patent Office has enacted the above captioned Resolution to clear the way to grant of such Argentine applications with foreign counterparts granted in the corresponding country.
The most important aspects of the present Resolution are:
It is applied to such patent application filed under the new Patent Act 24481 enacted on March 1996.
If the foreign counterpart on which the priority rights are based has been granted, the Argentine application will proceed to grant if it complies with the local formal requirements and no local prior art is uncovered.
A copy of the Foreign counterpart, together with a translation of its claims into Spanish, must be filed with the Argentine Patent Office.
The Argentine claims must have a scope not exceeding the scope granted in the counterpart.
This Resolution will be in force within one year, but it will be automatically renewed until the emergency situation is overcome.
