Special Protection to Well-known Trademarks in Beijing

In order to implement the command of the National Office for Rectifying and Standardizing the Order of the Market Economy, crack down on the illegal activity of selling counterfeit famous foreign commodities, and protect the exclusive rights of foreign trademark proprietors, the Beijing Municipal Administration for Industry and Commerce (BMAIC) published a notice on March 14, 2005, prohibiting the sale of counterfeit foreign well-known brands in China.

This second notice, issued at the request of some foreign trademark proprietors, aims to effectively protect the legitimate interests and rights of the proprietors of foreign well-known trademarks in China.
The second patch of well-known trademarks, which would be barred from sale at clothing wholesale markets and petty commodity wholesale markets within the jurisdiction governed by the BMAIC, covers "MONTBLANC," "DUNHILL," "CARTIER," "PIAGET," "BOSS," and others.
The first notice was issued in 2004 to protect 25 foreign well-known trademarks including "LOUIS VUITTON," "PRADA," "CHANEL," "GIVENCHY," and "BURBERRY."
Consequently, the BMAIC shall impose penalties upon those convicted of illegally selling counterfeit world-famous brands in accordance with relevant laws and regulations in China.
