First Case on Patent Infringement

In a further proof of the expanding commitment by Arab Countries to intellectual property rights, and their willingness to enforce these laws, the Saudi Judiciary has recently issued a decision in favor of a foreign company against a local patent infringer.
By virtue of Article 48 of the Patents Law, the Patent Cases Examination Committee issued a sentence ordering a Saudi company to cease the production and marketing of two medicines for eye pressure.
The US Company, Merck and Company Incorporated, relied in its case filed against Jamjoum Farma Company on the fact that the former is one of the world's largest and well-known medical companies and that it markets its products through registration certificate No. 2002.
The Committee compelled the infringing company to cease the production and marketing of the two pharmaceutical products, (Zola) and (Zolamol), which are eye medications without granting any damages to the prejudiced company.
