Since joining the World Trade Organization (WTO), India has been exerting continuous efforts to modernize its laws and regulations to match the international standards. One of the necessary conditions of joining the WTO is signing and abiding by the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs).
Therefore, all member states must update, revise, amend or otherwise replace their existing intellectual property laws so that they are in harmony with those demanded by the TRIPs Agreement.
As there is a well-established statutory, administrative and judicial framework to safeguard rights, whether they relate to trademarks, copyright, industrial designs or geographical indications, India is gearing up for the introduction of a new WTO-compliant Patent Act by January 1st 2005, which, apart from making India competitive, would also protect the public interest and foster economic growth.
