Implementing Regulations for Patents to Be Issued in Yemen Next Month

The Registrar of Intellectual Property at the Ministry of Industry and Trade in Yemen, Fadhil Mokbil Mansour revealed that the Implementing Regulations for the Patents Law will be released next month, official sources told ag-IP-news Agency.

The Intellectual Property Law No. 19, which includes Copyright, Trademarks, Industrial Designs and Patents, was issued in 1994.
The implementing regulations for trademarks and designs were issued, while the implementing regulations for patents were not.

The Yemeni Patent Office (YPO) started to accept filing of patent applications since 1998 without any further related actions such as examination, publication, granting, or annuity payments for application, which had to be delayed until the issuance of the Implementing Regulations.

In addition, “Yemenis are drafting new separate laws for trademarks, patents and designs to comply with the Trade-Related Aspects of Intellectual Property Rights (TRIPS) agreement and they wish to issue the Implementing Regulations to the proposed new laws soon,” the sources added.

However, the new laws were postponed until further negotiation with the World Trade Organization (WTO) as Yemen is still in the negotiation stage to become a member in the WTO.
