Regulations No.37 For The Year 2000 Amending The Trademark Implementing Regulations:

The New Jordanian Trademark Law of 1999 is currently being implemented after the issuance of the regulations No. 37 for the year 2000 published in the official gazette No. 4452 dated august 31, 2000. Jordan Office started filing service marks as of the publication of the law in December 1999, these applications have remained pending until September 3, 2000. Currently the registrar is reviewing all service marks and our office is beginning to receive examination reports.

Article (1)
These regulations may be cited as "Regulations for the year 2000 Amending the Trademark Implementing Regulations", and shall be read together with Regulations No. (1) for 1952 hereinafter referred to as the Original Regulations, and shall go into effect as from the date of their publication in the Official Gazette.

Article (2)
The Original Regulations shall be amended by canceling the term "appendix" wherever it occurs and replacing it by the term "table".

Article (3)
Article (50) of the Original Regulations shall be cancelled.

Article (4)
Article (51) of the Original Regulations shall be cancelled.

Article (5)
Article (52)
of the Original Regulations shall be cancelled and replaced by the following text:

Article (52) If a trademark is cancelled or stricken off for any reason, the registrar shall record this in the register, and indicate the reasons for such cancellation or striking off.

Article (6)
Table No. (1) of the Original Regulations relating to the fees charged by the registrar on the applications for trademark registration and the relating procedures shall be cancelled and replaced with the following table of fees:

Table No. (1)

Application for registering a trademark for one item up to ten items in one class: JD20.
Application for registering a trademark if the number of the items in one class exceeds ten: JD40.
Application for registering a collective mark related to one or more items in one class JD100.
Notice of opposition to each application for registering a trademark: JD100.
Notice of filing a counter-statement to a notice of opposition to an application for registering a trademark: JD10.
6.Evidence submitted by the agent of the opposing party in support of opposition for each time evidence is submitted: JD10.
7.Evidence submitted by the opposed party for each time such evidence is submitted: JD10.
8.Submission of a declaration for canceling or striking off a trademark JD150.
9.Submission of a counter-statement in answer to a declaration for canceling or striking off a trademark: JD10.
10.Submission of evidence by the plaintiff who requested canceling or striking off a trademark: JD10 for each time.
11.Submission of evidence by the defendant whose trademark is requested to be cancelled or stricken off: JD10 for each time.
12.Application to hear the statements of an applicant for registering a trademark: JD10.
13.Issuing a trademark registration certificate: JD25.
14.Application for registering a transfer of ownership, mortgage, or license to use a trademark: JD30.
15.Application to make any change in the register relating to a trademark: JD10.
16.Application to renew the registration of a trademark: JD20
17.Application to record an addition to the registered items of a trademark, or any change to the registered trademark: JD10.
18.Application to cancel a restriction on the use of a registered trademark JD10.
19.Application to make an inspection according to Article (77) of these regulations: JD10.
20.Application for issuing any certificate by the registrar: JD10.
21.Application to certify a photocopy of any document relating to a trademark: JD10.
22.Any application not provided for in these regulations: JD10.

Article (7)
Table No. (4) to the Original Regulations relating to the names of classes shall be amended by adding classes (35) to (42) relating to the following services:

Class No. (35): Advertising, business administration, administration works.

Class No. (36): Insurance, finance, financial services, real estate.

Class No. (37): Contracting, maintenance, supply.

Class No. (38): Communications.

Class No. (39): Transportation, goods arrangement and storage, travel.

Class No. (40): Handling of materials.

Class No. (41): Teaching, training, entertainment, sports and cultural activities.

Class No. (42): Food and beverage, temporary accommodation, medical and health care, beauty care, veterinary and agricultural services, legal services, scientific and industrial research, computer programming, services which cannot be included in other classes.
