The Trademarks Act, 1999 has been passed by the Indian Parliament. We are informed that the Act is likely to come into force on 1st September 2000.
Under the New Act the definition of a trademark has been amended to include device, heading, label, shape of goods, packaging, combination of colours, etc.
Service marks can be registered.
Well-known trademarks can be registered. A well-known trademark means a mark which has become so to a substantial segment of the public, which uses such goods or receives such services, that the use of such mark in relation to other goods or services would be likely to be taken as indicating a connection in the course of trade or rendering of services between those goods or services and the owner of the well-known mark.
Collective marks can be registered.
Infringement of trademark is a cognizable offence.
