Ralph Lauren Wins Fight Over Polo Name

Polo Ralph Lauren has won a trademark infringement lawsuit against Westchester Media Company, publisher of Polo magazine.

A federal judge in Dallas on Wednesday gave Westchester 90 days to stop using the Polo magazine name.

US Magistrate Judge Mary Milloy said it was "inescapable" that the magazine would cause consumer confusing with the clothing, fragrance and home furnishings designer.

"We are pleased that the court has recognized the need to protect our customers from the confusion intentionally caused by the new Polo magazine," said Victor Cohen, a lawyer for Polo Ralph Lauren, said in a news release.

Polo Ralph Lauren asked Westchester to give up the name after its overhaul from a small specialty publication into a slick, broader-focused magazine that launched with about one million (issues).

Westchester responded by suing to protect the name secured by founder and former publisher Ami Shinitski in 1992. Attorneys for the magazine had argued that it is the official publication of the US Polo Association despite its transformation into a glossy lifestyle Journal.

But the judge said the change in format clearly shows "an intent to trade on the reputation and goodwill established by Polo Ralph Lauren over the last 30 years."
