The Shura Council has recently approved the Anti-dumping Law, Compensatory Measures and Precautionary Protection. The Law shall be submitted to the Council of Ministers for endorsement after the Committee of Economic Affairs has finished drafting the articles of the Law.
Here are some of the Articles mentioned in the Law:
· Article (4) allows imposing precautionary protection on goods imported to the Kingdom when the products in question are imported in increasing amounts causing harm to national products.
· Article (6) permits, in state of emergency, adopting temporary precautionary protection measures when imports have undoubtedly caused serious damage to national industry provided that the temporary protection period shall not exceed 200 days.
· Article (10) states that the Minister of Trade and Industry shall establish investigation committees specialized in dumping cases. A permanent committee for anti-dumping, support and protection shall be established at the Ministry of Trade and Industry. The appointed committee shall incorporate different Ministries such as: Ministry of Trade and Industry, Ministry of Finance, Ministry of Agriculture and others.
· The Customs Department shall be in charge of collecting fees imposed as per the Anti-dumping Law. Such fees shall be differentiated from customs tariffs and any other tariffs imposed on imports.
· Article (18) grants importers and exporters the right to appeal decisions issued as per this law before the Board of Grievances within 60 days as of the date of publishing the said Law in the Official Gazette.
The Council of Ministers shall, upon the recommendations of the Minister of Trade and Industry, issue the Implementing Regulations within 90 days as of the issuance of this law.
