An application for trademark “NILOOFAR & mouse Device” was filed by an Iranian company for International Classes 1, 3 and 32 in Iran. Disney Enterprises Inc. filed an administrative opposition against that application since the said trademark is (similar to the MICKY MOUSE mark). The case was referred to the court and a decision issued in favor of Disney Enterprise Inc.
The court claimed that the trademark “MICKEY MOUSE & Mouse Device” is a well-known trademark due to continuous usage on products and public awareness of the mark. Therefore, according to Article 9, Note 2 and Articles 16 and 20 of the trademark law of Iran, the application by the Iranian company has been canceled.
