UAE Amends Resolution for Collection TM Publication and Registration Fees

ABU DHABI – Abu-Ghazaleh Intellectual Property (AGIP) would like to inform its clients that the UAE Minister of Economy H.E. Sultan bin Saeed Al Mansouri issued on February 14, 2010 the Ministerial Resolution No. (66) of 2010 amending the Ministerial Resolution No. (541) of 2009 regarding the collection of trademark publication and registration fees.

The five-article Resolution is as follows:

Article 1
The fees of publishing the trademark in the special bulletin issued by the Ministry and the fees for the registration of a trademark or a group of marks for goods, products or services in a certain class shall be collected within 30 days of the applicant being notified of accepting the filing of the application.
The applicant shall publish the trademark application in the trademarks bulletin and two local newspapers within 30 days from the approval of the publication form, otherwise the application shall be considered cancelled.

Article 2
Registration fees for a trademark or a group of trademarks for goods, products or services covered by one class shall be collected within 30 days from the elapse of the 30 day opposition period starting from the publication date as per Article 14 of the Federal Law No. 37 of 1992 on trademarks.

Article 3
The trademarks directorate shall notify the applicant of the content of Article (1) and Article (2) of this resolution upon accepting the filing of the application.

Article 4
Article (1) of Ministerial Resolution No. (541) of 2009 shall be cancelled.

Article 5
This resolution shall be published in the official gazette and shall be effective as of the date of issuance.

The Resolution was issued in Abu Dhabi on February 14, 2010.
