TRIPOLI – Abu-Ghazaleh Intellectual Property (AGIP) would like to notify its clients that the General People's Committee in Libya has issued decision No. 316 on July 5, 2009 to amend and add some articles to the Implementing Regulations of the Trademark Law No. 40 of 1956 as follows:
- To amend (article 29 Bis): Trademark license with regard to products or services of the same class shall not be granted to more than one person. As well, a license may not be granted to more than one person with regard to associated trademarks registered in the same class.
The trademark license agreement shall include the license duration which shall not exceed the trademark’s protection period.
- A new form was approved for the trademark registration certificates which shall be immediately applied upon issuing the registration certificate in the future. It is worth mentioning that there is no specified date for the certification’s issuance process.
- Based on decision No. 316 which amends the Implementing Regulations, the classification of products and services shall be amended as follows:
Class 10: Veterinary apparatus and instruments were added as they are not included in the old Implementing Regulations.
Class 28: Decorations for Christmas trees and related products were deleted.
This decision shall come into force as from the date of its issuance and shall supersede any provision in contrary, and shall be published in the procedures notice.
