The Apex Court of India Sets Guidelines for all IP Litigation in Lower Courts

NEW DELHI – Abu-Ghazaleh Intellectual Property (AGIP) would like to notify its clients that the Supreme Court (Apex) of India has directed the lower courts to speed up all Intellectual Property (IP) litigation cases to give the final judgment normally within four months.

This directive came on September 16, 2009 along with other directives to the Madras High Court to speed up the prosecution of the Bajaj versus TVS infringement case on merits, in the judgment against an appeal on injunction.

Commenting on this, Mr. Khalid Odeh, AGIP India executive director said “This is a landmark judgment by the Supreme Court, which could lead to a better enforcement of IP regime in India.”
