Decision on Copyright Payments to Music Editors

A major music recording company has been allowed to continue paying copyright payments at the 1997 rate.

The ruling handed down from the Superior Court of the State of Rio de Janeiro has meant that the Brazilian Association of Music Editors (ABEM) will only receive remuneration based on the 1997 criteria of 8.4% over the unit price.

Based on ABEM’s 1999 decision to increase the remuneration charged to recording companies, most of the major recording companies filed lawsuits to contest the increased fees.

The decision is the first one that upholds such a claim from a recording company. Additionally, some editor companies that are related to major recording companies have left ABEM and established a
new editor companies association.
