Trade Marks Ordinance, 2001 Enforced in Pakistan

Abu-Ghazaleh Intellectual Property (AGIP) would like to inform its clients that the Government of Pakistan has issued notification for enforcement of the Trade Marks Ordinance, 2001 with effect from April 12, 2004. 

By virtue of the new law, service marks are now registrable in Pakistan and priority from a member country of the Paris Convention can be claimed in respect of registration of trademark for goods and services.

Furthermore, as per the new law, applications for domain names, certification marks, collective marks and divisional marks are also available.

AGIP advises its clients to send their instructions as soon as possible so that such applications are filed immediately at the beginning of service marks filings. This will deter any possible infringements and would preserve our clients’ priority in their service marks. 

Filing requirements for service marks are the same as for trademarks.

It is worth noting that the Patents Rules 2003 relating to Patents Ordinance 2000 (As Amended by Patents (Amendments) Ordinance, 2002) have been issued and published in the Official Gazette of Pakistan December 31, 2003.
