Trademark Registration with Customs Initiated in Paraguay

ASUNCIÓN, PARAGUAY - The General Director of the Paraguayan Customs Office issued Resolution No. 101, on February 22, 2008, which officially states the beginning of the implementation of the borderline measures to protect trademark rights in Paraguay.
According to MERSAN Abogados Attorneys and Counselors At Law, Resolution No. 101 creates a Trademark Registration System with the Customs Office, by which a titleholder of a trademark in Paraguay, who wants to be a beneficiary of the borderline measures, must file an application before the Customs Office, indicating what kind of products are intended by the trademark, and, optionally, deliver samples or digital files of the samples.
The following documents are required for obtaining a Customs registration of a trademark:
1. A Power of Attorney which only requires Notarial certification, no consular legalization is necessary;
2. A copy of the Trademark Registration Certificate duly notarized by the Industrial Property Office;
3. Name of the trademark or its graphical representation when dealing with a figurative trademark;
4. A list of the main products intended by the trademark;
5. Samples of such products (optional).
It is noteworthy that the expiration of the Customs registration is subject to the expiration date of the trademark registration. Once this trademark registration is renewed at the Industrial Property Office, such renewal may be recorded at the Customs Office.
