Following the issuance of patent regulations on December 13, 2001, we would like to draw all our clients’ kind attention that the following documents are required for filing a patent application in Jordan:
- A declaration supplemented by oath (affidavit) signed by the inventor(s) and to be notarized and legalized up to the Jordanian Consulate. The old patent form No.1 is no more valid and should be
replaced with the new affidavit for all applications filed on and after December 1, 1999. This is applicable only if the applicant is different from the inventor. In other words, if the inventor is the
applicant, there would be no need to replace the form already submitted at the Patent Office. For a new application, kindly use the new affidavit form No. 4 instead of the old patent form No.1. This form is available on our web site: www.agip.com.
- A certificate of incorporation of the company or corporation, or a copy of the memorandum and articles of association, as the case maybe if the applicant is a corporate person. (certified; no need for
notarization or legalization) - A document establishing the applicant's right in the invention, if the applicant is not the inventor (certified; no need to be notarized or legalized).
- A power of attorney notarized and legalized up to the Jordanian
Consulate.
- A copy of the prior application and the documents attached thereto as well as a certificate indicating its filing date, filing number and the country it was filed in if the application contains a claim for the priority rights according to Article (10) of the Patent Law.
- The issued provisional protection certificate for the inventions which are displayed in official exhibitions if available (certified; no need for notarization or legalization).
- All the documents submitted pursuant to the provisions of the regulation should be accompanied by an Arabic translation if they are written in English or an Arabic and English translations if they are
written in another language.
The above documents must be submitted within 60 days as of the filing date for applications filed on February 17, 2002 and after. Failure to do so would result in canceling the application. Failure to file
the priority document during the said grace period would result in the loss of the right to claim priority. For the pending applications filed on and after December 1, 1999 until February 17, 2002, the
deadline to submit the required documents is June 1, 2002. Failure to do so would result in the loss of the application. However, an extension of time is possible upon client’s request. Kindly make sure
to send all the required documents together in order to complete the filing formalities and to speed up the acceptance process.
We would also like to draw your kind attention that due to a substantial increase in the official fees with retroactive effect as of December 1, 1999, a supplementary invoice shall be forwarded to you by our Regional Office shortly.
Should the Registrar decide to examine the patent application, a separate invoice of the examination fees will be forwarded to you. However, if you provide us with a copy of the letters-patent issued in the home country, the application will be exempted from examination. Regarding publication in the official gazette, the following is required:
A brief description of the invention and the new claims whose protection is sought, in about (200) words for the purpose of publication in the official gazette. The said brief description should be independent of the application; and it should comprise the following:
The name of the inventor and the applicant if the applicant is not the inventor, and the address of both of them.
A summary of the specifications of the invention, the claims whose protection is sought and any illustrative drawings associated with it. The said summary should indicate the technical or scientific
field of the invention and should give a clear idea of the technical problem, the essence of its solution as well as the main uses of the invention.
The chemical formula which best distinguishes the invention compared with the other formula listed in the application if needed and if the invention is a chemical one.
The best suited illustrative drawing among those presented by the applicant.
