The Yemeni Minister of Industry and Trade issued new regulations for filing, examining, publishing and registering a design or industrial model. Issued on April 3, 2000, the ministerial decree (No. 61)
states, in Article 1, that the application for registering an industrial design or industrial model should be submitted to the Administration of Commercial and Industrial Intellectual Property and Patents (ACIIPP).
The applicant or one acting on its behalf should fill a special form and attach to it necessary documents, such as a consice definition of the design or industrial model, a detailed description of the design
or industrial model including relevant drawings and pictures and documents proving practice.
The ACIIPP, states Article 3, is to examine the appropriateness of the formal aspects of the application and the required documents. It also examines the technical aspects to make sure that there had been
no former identical or similar registration.
Article 4 designates the ‘Commerce Gazette’, as the means through which the registered design or industrial model is published, assigned, cancelled or renewed.
The regulations that became effective from the issuance date of April 3, 2002 and will be published in the ‘Commerce Gazette’, set fees for the registration of designs and industrial models.
For that purpose, the new regulations included a detailed table that lists the various aspects relevant to the process of registration. The fees range from 5000 – 20000 Yemeni Riyal, (US $ 30.00 - 120.00).
