Russian Trademark Filing Form to Include Use Confirmation and Risk Disclosure
MOSCOW - The Government of Russia has finalized a new requirement for trademark and service mark filings. Effective August 18, 2026, the application form for filing marks will include a clause in which the applicant must confirm their intention to use the designation for all designated goods and services.
In accordance with the Order of the Ministry of Economic Development of the Russian Federation of May 13, 2026, No. 386, issued on August 7, 2026, applicants are now required to certify their intent to use the claimed designation as a trademark or service mark for all goods and/or services listed in the State Register of Trademarks and Service Marks of the Russian Federation. This confirmation aims to align filing practices with actual use and strengthen the integrity of the register.
It is important to note that there is no legal obligation to confirm the use of a trademark after its registration, unless such confirmation is specifically required as part of legal proceedings.
