Trademarks and service marks are registered in St. Lucia under the Trademark Act No. 22 of 2001 and supplemented by the Trademarks Regulations No. 17 of 2003.

Registration

A trademark may be registered in respect of either goods, services, or both and shall be registered as follows:

  • In the name of the applicant for registration.
  • In respect of either goods, services, or both specified in the application at the time of registration.
  • Subject to the conditions and limitations, if any, imposed by the Registrar in accepting the application for registration or deciding to register the trademark.

A trademark may not be registered under the Act if it is:

  • Substantially identical with, or deceptively similar to, a trademark registered by another person in respect of similar goods or closely related goods.
  • Likely to deceive or cause confusion of a scandalous matter.
  • Contrary to law.
  • Not capable of being represented graphically.
  • Not capable of distinguishing the applicant’s goods or services in respect of which the trademark is sought to be registered from the goods or services of other persons.
  • Contains or consists of a sign that is prescribed not to be used as trademark.

Classification

The classification of goods and services are based on the Nice Classification, Eighth Edition.


Registration Procedure

  • Following the receipt of letter of instructions and all required information and documents, we proceed with the preparation of the application.
  • he application is then filed at the Registry of Intellectual Property at which stage it is given a registration number.
  • The Registrar then examines the application and prepares an Examination Report on the registrability of the mark.
  • The Examination Report is then forwarded to us (the Agent) with notes as to whether the application has been accepted for registration, or whether it was rejected, and the reasons for rejection. This report contains particulars of the mark to be registered, the class in which it is to be registered, and the number of the mark.
  • A copy of this report is subsequently sent to the applicant or the intermediary (as the case may be) for his records.
  • Once the mark is accepted for registration, we proceed with paying the prescribed fee to have the mark published in the St. Lucia Gazette. Then, a notice of the application of the mark is advertised in the Gazette.
  • If after three months from the date of the publication of the advertisement, there is no opposition to the registration, the Registrar proceeds with issuing the Certificate of Registration.
  • The Certificate is then sent to the intermediary or the client.

Duration of Registration

Registration is valid for ten (10) years and is renewable for further consecutive periods of ten (10) years upon payment of the prescribed fee.
