Utility Model protection is available for any new arrangement, shape of tools, work instruments, utensils, devices, or objects having an industrial nature and which implies an improvement of their function. Utility model certificates are granted for an un-extendible term of ten years from filing.

Argentina is a member of the Paris Convention for the Protection of Industrial Property as of February 10, 1967.
In the absence of prior disclosure of an invention, in Argentina or abroad, an independent utility model certificate may be obtained.

The application may be made in the name of an individual or a company.

Disclosure by the inventor within one year, either prior to filing in Argentina or to the claimed priority, is not a bar to obtaining a valid utility model certificate. However, foreign patents, utility model certificates, or publications of patent or utility model applications are not considered to be disclosures by the inventor.
