Filing Requirements for Trademarks/Service Marks

Note: All documents must be in English or Bengali. If any document/s is in any language other than English, then a certified translation or transliteration should be submitted

Basic Requirements
1. Simply signed POA. 
2. Name, address, nationality of the applicant.
3. List of goods or services classified as per Class 01-45 of Nice Classifications  
4. Clear copy of the mark in jpg. or pdf. 
5. State whether the applicant wants to apply in Bangladesh as “manufacturer”, “importer” or “service-provider.”  
6. Date from which the mark has been in use in Bangladesh or when does the applicant intend to use the mark in Bangladesh or if the mark is to be filed on the basis of proposed-to-be-used (if applicable)
7. If the priority (if applicable) is claimed then certified priority documents should be provided.

Conditional Requirements

1. If the applicant wants to apply as an importer other than manufacturer or service provider, then import license or registration documents, manufacturer’s permission letter to use the mark by importer (when importer is different than manufacturer) and the information about whether the importer buys all or partial production from manufacturer have to be submitted.
2. If there is any human picture in the logo/label then the NOC from that person may be submitted.
  
Assignment:
1. Simply signed POA. 
2. Name, address, nationality of the applicant.
3. Signed Form 24 by both Assignor and Assignee is to be submitted
4. Trademark application/registration number. 
5. Clear copy of the mark in jpg. or pdf.
6.A copy of the Deed of Assignment executed by the Assignor and Assignee and duly attested by the Bangladeshi Embassy in the country where the deed was executed.
7. State whether the assignment is with or without the goodwill of business. If it is without goodwill then it has to be applied for registration within 6 months from the assignment deed.
8. If the title is assigned to a company from an individual and if the company is incorporated after the trademark application, then the applicant shall submit the evidence with an Affidavit that the trademark has been used in the business operated in Bangladesh before the date of assignment of title to the company.

Renewal: 
1. Simply signed POA 
2. Name, address, nationality of the applicant
3. Registration number of the mark
4. Class in which the application is made
5. Date of expiry of the registration
6. Copy of registration certificate (if available)

True Copy:

1. Simply signed POA 
2. Name, address, nationality of the applicant
3. Brief description or details of the copy of the document requested, namely application/registration number, class, mark name or description or any other detail (if available)
4. Copy of certificate or application number (if applicable/available) and brief description or details of the copy of the document requested 

Change of Name and Address
1. Simply signed POA 
2. Name, address, nationality of the applicant
3. Application number or registration 
4. Current name or address, proposed name or address, class
5. Confirmation document/letter in the applicant’s company letterhead 
6. Confirmation document/letter in the applicant’s company letterhead from concerned official/Government Department
7. If any document/s is in any language other than English, then a certified translation or transliteration should be submitted”
