DAMASCUS - The Syrian People's Assembly passed on March 29, 2012, during a session chaired by Dr. Mahmoud Al-Abrash, Speaker of Parliament, a draft law on Patents, Utility Models, Integrated Circuits and Layouts which will replace the existing Law No. 47 of 1946.
The new law has been drafted in response to the changing economic variables on the local, regional and international levels, the continued need to improve intellectual property protection, as well as to provide an environment that encourages investments, trade, technology transfer and innovation.
The most important features of the new law could be summarized as follows:
1. A substantive examination will be conducted of the applications prior to the publication stage. All applications that fail to meet the provisions of this law and its Implementing Regulations shall lapse.
2. The term of a patent protection is 20 years instead of 15 years starting from the date of filing the application at the Syrian Patent Office.
3. The new patent law defines the “patent” and “utility model” and provides the conditions that should be available in a patent and utility model to be patentable such as novelty, inventiveness and applicability of invention.
4. In line with the new patent law, new provisions have been adopted against infringements of intellectual property rights.
