New PCT Regulations in Iran

TEHRAN - The Iranian Intellectual Property Office (IIPO) announced that new regulations have been applied to all PCT applications in Iran, for granted, pending and future cases, as from May 30, 2018.

The new regulations are summarized as follows:

1. Term of protection: 20 years from PCT filing date, not Iranian application date. IIPO will issue a notification for all granted patents with regard to this issue.

2. PCT patents are subject to annuity payments as from PCT filing date, and all past annuities must be paid, thus patent applications filed on May 30, 2018 onward are subject to additional annuity payments.  However, for PCT filings which have completed the national phase and either the patent certificate or the notification of acceptance has been issued for them before the said date, the IIPO has not made the final decision whether their past annuities must be paid or not. 

3. PCT applications that are in the process of registration must pay the missing annuities prior to granting the patent.
