Requirements

Filing Requirements
Patent and Utility Model Applications

A) Documents must be filed with the application:

1. Specifications of the Patent, to include the following (must be in English in word document):

a) The title of the invention and a summary description of the invention 

b) Clear drawings of the patent

c) The patent claims

2. The name, address and nationality of the applicant and the inventor.

3. A copy of the PCT application as filed (mentioning the priority number and date).

B) Documents can be late filed (within 3 months from the application filing date):

1. A Power of Attorney signed in the name of the applicant and must be legalized up to the Bahraini Consulate or authenticated by an Apostille.

2. In case the applicant is not the inventor, we will require a simply signed copy of the deed of assignment between the applicant and the inventor

Note: Clear scanned copies of the above requirements under item 1 & 2 via email is sufficient and originals are not required.

3.  If the subject patent application is related to Microorganisms, we require a Certificate of Deposit of Microorganism culture.

4. If the patent application is related to Genetic resources or traditional knowledge, we require the documents indicating that the inventor got the genetic resource or the traditional knowledge legally.

C) Arabic translation of the patent's full specifications, claims & drawings (which can be submitted within (4) months from the filing date.)
As per the current procedures at the Patent office it is possible to proceed with the filing without submitting the legalized Power of Attorney and the Deed of Assignment documents, provided that the legalized documents (up to the Bahraini Embassy/Apostilled) can be late-filed within a grace period of ninety (90) days from the filing date.

Assignment Applications requirements:
1. A signed Power of Attorney by the Assignee, duly legalized up to the Bahrain Consulate or authenticated by the Apostille.
2. A deed of assignment executed by both parties and duly legalized up to the Bahrain Consulate or authenticated by the Apostille.
License Agreement Applications requirements:
1. A signed Power of Attorney from the Licensee, and duly legalized up to the Bahrain Consulate or authenticated by the Apostille
2. License agreement executed by both parties (owner and the Licensee), duly legalized up to the Bahrain Consulate or authenticated by the Apostille.

Change of Name/Address Applications requirements:
1. A signed Power of Attorney, and duly legalized up to the Bahrain Consulate or authenticated by the Apostille, showing the new name/address.
2. A certificate proving the change of name or address issued by a competent authority of the applicant’s domicile and duly legalized up to the Bahrain Consulate or authenticated by the Apostille
