Requirements for Filing Trademark Applications

The following information and documentation are required to file a trademark application:

1. Name and address of the applicant.

2. One representation of the trademark, or 20 representations, if the sign has a graphical part, to be sent in electronic format.

3. A list of the goods to be covered.

4. A Power of Attorney duly signed by the applicant (no legalization is required).

In connection with the period for registration, and according to the Cuban law, the final decision of the Cuban Industrial Property Office (CIPO) should be issued in one year term. However, in the practice it can delay until 2 years. The registration of a trademark in Cuba will be valid for ten years.

Requirements for Patent Applications 

1. Summary, description, claims and drawings (to be sent through E-mail, fax or courier).

2. Certified copy of priority and its Spanish translation. It must be submitted within three months of request.

3. Power of Attorney signed by the applicant.

4. Certificate of Cession signed by the inventors on behalf of the applicant.

5. A Spanish translation of all documents must be attached, duly verified and signed by the translator, in accordance with appropriate form.
